Please read these Terms & Conditions ("Terms") carefully before using TuitionLah.com ("the Platform"). By accessing or using the Platform, creating an account, or clicking "I agree", you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Platform Operator

TuitionLah.com is owned and operated by Adaptels Pte. Ltd.("Adaptels", "we", "us", "our"), a company incorporated in the Republic of Singapore.

TuitionLah is a platform that connects private tutors with students and parents seeking tuition services in Singapore. We are not a tuition agency, not an employment agency, and we do not provide, arrange, supervise, or guarantee any tuition services. All tuition arrangements are made directly between tutors and parents/students.

2. Eligibility

  • You must be at least 18 years old to create an account.
  • Parents or legal guardians may create accounts on behalf of their children for the purpose of finding tutors.
  • By creating an account, you represent and warrant that all information you provide is accurate, current, and complete.

3. User Responsibilities

  • You are solely responsible for the accuracy, completeness, and truthfulness of all information in your profile, including qualifications, experience, rates, and contact details.
  • You are responsible for maintaining the confidentiality and security of your account credentials.
  • You acknowledge that you are sharing your personal data (including your WhatsApp number) voluntarily and that such data may be disclosed to other registered users of the Platform for the purpose of tuition matching.
  • Tutors are independent contractors and are not employees, agents, or representatives of Adaptels Pte. Ltd. Tutors are solely responsible for their own tax obligations, professional conduct, and compliance with all applicable laws.
  • Parents and students are solely responsible for evaluating the suitability, qualifications, and background of any tutor before engaging their services.

4. Consent to Personal Data Collection & Sharing

By registering for an account on TuitionLah, you explicitly consent to:

  • The collection, use, and disclosure of your personal data as described in our Privacy Policy.
  • Your WhatsApp number and contact information being revealed to other registered users of the Platform for the purpose of tuition matching and communication.
  • Your profile information (name, qualifications, subjects, rates, locations, bio) being publicly displayed on the Platform.
  • Receiving platform-related communications via email or other channels.

This consent is given in accordance with the Personal Data Protection Act 2012 ("PDPA") of Singapore. You may withdraw your consent at any time by deleting your account, subject to the terms of our Privacy Policy.

5. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Adaptels Pte. Ltd., its directors, officers, employees, and agents from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Any interactions, communications, disputes, or arrangements between tutors and parents/students made through or as a result of the Platform.
  • The accuracy, completeness, or truthfulness of information provided by you or any other user on the Platform.
  • The quality, safety, suitability, or outcome of any tuition services arranged through the Platform.
  • Any misuse or unauthorised disclosure of another user's personal data (including WhatsApp numbers) by you, including using other users' data for purposes unrelated to tuition matching.
  • Your breach of these Terms or any applicable law or regulation.
  • Any claim by a third party related to your use of the Platform or your conduct as a tutor or parent/student.

6. Disclaimers

  • Adaptels does not verify tutor qualifications, certifications, background checks, criminal records, or credentials of any kind. Profiles are self-reported by users.
  • Adaptels makes no guarantee or warranty about the quality, safety, reliability, or suitability of any tutor listed on the Platform.
  • Adaptels is not responsible for any loss, damage, injury, or harm arising from tutor-student arrangements, whether direct, indirect, incidental, or consequential.
  • Adaptels is not a partyto any agreement, contract, or arrangement between tutors and parents/students. All such arrangements are made at the users' own risk.
  • Users engage tutors entirely at their own risk. Parents and students should exercise their own due diligence, including conducting their own background checks and reference verification.

7. Platform Provided "As Is"

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or availability. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

8. Limitation of Liability

TuitionLah is a free platform. To the maximum extent permitted by applicable law:

  • Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded by applicable law, including under the Unfair Contract Terms Act (Cap. 396).
  • Subject to the above, Adaptels Pte. Ltd.'s total aggregate liability to you for any and all claims arising out of or relating to the Platform or these Terms shall not exceed SGD $100 (one hundred dollars) or the total fees paid by you to Adaptels in the 12 months preceding the claim, whichever is greater.
  • In no event shall Adaptels be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of revenue, profits, data, goodwill, or other intangible losses, regardless of the cause of action.
  • You acknowledge that TuitionLah is provided free of charge and that the limitations of liability in this section reflect a reasonable allocation of risk between the parties.

9. Prohibited Conduct

You agree not to:

  • Post false, misleading, defamatory, or fraudulent information.
  • Use the Platform for any illegal, unlawful, or unauthorised purpose.
  • Spam, harass, stalk, or abuse other users.
  • Scrape, crawl, or use automated means to collect data from the Platform without our written consent.
  • Impersonate another person or entity.
  • Interfere with or disrupt the Platform's infrastructure or security.
  • Collect or store other users' personal data for purposes unrelated to tuition matching.
  • Use other users' contact information for unsolicited marketing, advertising, or commercial purposes.

Adaptels reserves the right to remove any content, suspend or terminate any account, and take any other action we deem necessary to enforce these Terms, at our sole discretion and without prior notice.

10. Intellectual Property

All content on TuitionLah (design, text, graphics, logos, software) is owned by Adaptels Pte. Ltd. and protected by copyright and other intellectual property laws. User-submitted content (profiles, requests) remains the property of the user, but by submitting it you grant Adaptels a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute such content on the Platform.

11. Account Termination

  • You may delete your account at any time. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
  • We may suspend or terminate your account at any time, for any reason, without prior notice, including for breach of these Terms.
  • Provisions of these Terms that by their nature should survive termination (including indemnification, limitation of liability, and disclaimers) shall survive.

12. Modifications to Terms

We may update these Terms at any time by posting the revised version on this page with an updated "Last updated" date. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising out of or in connection with these Terms or the Platform shall first be resolved through good-faith negotiation between the parties for a period of 30 days. If the dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts of Singapore.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Adaptels Pte. Ltd. regarding your use of the Platform and supersede all prior agreements and understandings.
